Every “balanced budget” amendment Congress proposes for itself always includes exceptions and allowances for emergencies or other excuses that would allow Congress to shirk the requirement if they felt they had sufficient need to blow the budget on unconstitutional spending again, just like they always do.

And indeed, somewhere between half and most of the acts of Congress these days are illegal, given that any power not specifically delegated to Congress by the Constitution is illegal.
